 Counterparty default, force majeure, international conventions and environmental risk are terms found in standard trading and terminating agreements. These terms obligate parties to perform. Should they not, indemnity obligations ensue. Failure to honor indemnity obligations results in counterparty default. To complicate matters further, international trade conventions limit the harmed parties' liabilities and assess the negligent parties additional liabilities. When you couple these events with an environmental release, commodity interests are exposed to a disproportionate share of risk, much of which is insurable. This article discusses elements of environmental risk commodity interests face when using common carriers and risk mitigation techniques.
