While we probably all acknowledge there is no such thing as a standard commercial umbrella, are we taking the time to understand how the products we sell are designed to work in a claim situation? If a policy calls itself an “umbrella,” does that guarantee that it is and that it provides all the coverage we associate with a true umbrella policy? If we compare two umbrella policies with what appear to be the same limits, but there is a significant price difference, could there be any underlying differences in coverage that we need to uncover? And if so, where should we begin our analysis? While we can’t possibly cover all the potential differences that may exist in coverage forms, we will discuss some key areas that you and your insureds need to be aware of, including:

  • Defining excess policies vs. umbrellas.
  • Can an umbrella ever respond as an excess policy only? A look at exclusions.
  • How is the umbrella or excess policy triggered? Does that matter?
  • Once triggered, how does it respond to the claim? Does it “pay on behalf of” or “indemnify”?
  • How are defense costs handled? Could this be why the price comparison is so different?
  • How does the umbrella or excess policy handle additional insureds and primary and non-contributory?
  • Recognizing how much more complicated and serious each issue becomes as more layers are added to the insured’s liability portfolio.
